The terms and conditions detailed below relate to the products
and services provided by IndigoJack Ltd.
1.Definitions
“We”
means IndigoJack Ltd. “Company” means IndigoJack Ltd.
“Client” means the person or persons signing the contract or
purchasing the products and services of IndigoJack Ltd online
through the website www.indigojack.com
2.Your
Right To Cancel
If
a contract is signed by you other than at the Company’s
premises, the Client is entitled to cancel the contract and
obtain a refund of any deposit. The Client can do this by
writing to us within seven days of the date on which the
contract was signed. The letter should be sent by recorded
delivery. No refund can be given to the Client for domain names
purchased in their business name or websites which have been
published to the world wide web within the seven day
cancellation period.
3.Our
Right to Cancel
We reserve the right to cancel the contract if: (1)The Client
makes frequent changes to the design brief which prevent the
website being completed within a reasonable time period-2
calendar months. (2)The Client
does not respond to our design queries which result in the
website design not being concluded satisfactorily.
The Client will
either:
a. Have their site
published and be given access to their Control Panel and Webmail
facilities, or..
b.
The
Client will receive a refund less any expenses incurred by the
Company.
It is entirely at the
discretion of the Company, to choose the appropriate option.
4.Once
the site has been published to the internet, you will be
responsible for it's contents in their entirety. It is therefore
in your interest to ensure that the information you send us to
add to your site is free for you to use. Beyond publication of
the site it is entirely your decision whether you retain the
site as it is or alter it. We will install a link on your site
which will direct visitors to us in order to report a bug. You
must not remove this link. We will repair free of charge bugs
resulting from our work but repair of bugs relating to
alterations to the site you have made will be subject to our
charges.
5.We
cannot be held responsible for any illegality arising from the
content of your site. It is entirely your responsibility to
obtain the necessary licenses, permits and insurance required
for your enterprise. If you have any doubts about these issues
please refer to the DTI website or read The Legal Guide To
Online Business by Susan Singleton (Law Pack Publishing).
6.We
strongly recommend that you do not publicise or have promotional
literature printed until the web site we design for you has been
thoroughly tested and is ready to be viewed. You should expect
to allow a week beyond publishing to lapse before your website
will be considered ready. We test your site extensively in our
test area however
there are errors that can occur when any site is moved
from one location to another and we will repair any defects
arising from such an act. We can not be held liable for any
expenses incurred by you for printing and publicity should you
choose to promote the web site before it has been 'passed'.
7.Throughout
the design process we will contact you via email. You must read
and respond to our queries. We cannot be held responsible for
delays resulting from your failure to give us the information or
guidance that we may request from time to time.
8.As
part of all our packages we submit your site to search engines
and add all the necessary meta tags and titles to your web pages
to give your site the best possible chance for gaining a listing
on the majority of search engines. We can not control your
position on a particular search engine and we only have a
certain amount of control over which pages a search engine
chooses to list.
9.We
maintain a back up of your website in various formats for 2
years beyond publishing. If you wish us to release your website
to you for you to edit and maintain, the copy we keep will be of
the website in it's original state. If we retain editorial
control of the website there will be an up to date copy of the
site which could be immediately uploaded in the event of a
problem. Acts of God not included.
10.Our
all-inclusive pricing structure does not include any upgrades
and extras applied to sites once published.
11.MiniSites
In
addition to the above conditions the following apply to our
MiniSite service. No refund can be given after a MiniSite has
been published to the world wide web. Clients are given Ftp
access to their website which means that they could download
their MiniSite at any time and save it to their computer.
Therefore no refund can be given.
12.Hosting
Subscription
hosting may be cancelled by the client at any time within the
billing period. No refunds will be given for part monthly use -
the hosting will be terminated at the end of the monthly billing
cycle.
13.Domain
Names
Once
purchased, no refund can be given for
the domain name we purchase on a clients behalf. This is
a policy implemented by the UK domain name registration body.
Clients should contact Nominet UK if they have any queries
regarding this issue.
14.Should
you cancel your MiniSite or BigSite order prior to publishing
but after the purchase of your chosen domain name, your domain
name will remain your property and any refund requested will
reflect this.
15.Pixel
Buy Pixel Advertising
Once
published to the PixelBuyPixel Homepage no refund can be given
should you then choose to cancel. After publication your website
link and keywords are deemed to have entered the public domain
and as such IndigoJack is not responsible for who views or
accesses your website by clicking on your pixel link.
16.Special
Offers
Sales
promotion gifts apply to completed sales only i.e. published
websites. Promotional gifts will be withdrawn if an order is
cancelled prior to publication.
17.Privacy
Policy
As
our valued customer your privacy is of the utmost importance to
us. The information you send to us is held securely and will not
be passed on to third parties in accordance with the Data
Protection Act 1998. None of your details will be passed on
to any other business or person not directly involved in the
processing of your payment. The personal details we request from
you are restricted to those we need for
the purpose of designing your website. Card payments are
processed by the PayPal online payment gateway. We do not
maintain a record of your card details. At your request your
personal details may be updated or removed at any time and we
would be happy to fulfil such a request.
18.We
will not use your email address to send you unnecessary emails.
We will only contact you via email through the course of the
design process and in response to your queries.
19.Disclaimers
a.We
are not responsible for the content of external sites that are
not part of the IndigoJack Ltd group of websites.
b.At
IndigoJack we add search engine optimisation to all websites
designed by us and we also submit those websites to all the
major search engines on a bi-monthly basis. It is
not within the control or the
responsibility of IndigoJack Ltd to
guarantee a search engine listing or a particular
position on search engine listings.
c.We are not responsible for a website that fails to
attract any business. We are not responsible for the quality,
pricing or authenticity of the Products and Services offered for
sale on our clients websites.
20.Law
These
Terms and Conditions have been constructed according to the Law
of England and Wales and any dispute with the Company should be
directed to the courts of England and Wales.
